Supreme Court Clarifies Timing of 24-Hour Custody Limit, Election Commission Restores Deleted Voters

The Supreme Court clarified that the 24-hour custody limit for detainees begins when they are taken into custody. The Election Commission restored the names of six voters deleted during a special intensive revision in Goa.

The Supreme Court has ruled that the 24-hour deadline to produce a detained person before a magistrate begins when they are taken into custody, not when the investigating agency formally records their arrest. This clarification was made in response to a case where any attempt to draw an artificial distinction between arrest and detention would dilute or negate the fundamental protection guaranteed by the Constitution. The only permissible exclusion is the time needed to travel to the magistrate’s court.

In a separate development, the Goa bench of the Bombay High Court directed the Election Commission to restore the names of six members of a family who were deleted from the electoral rolls during the special intensive revision. Their applications for a change of address had been rejected. The direction came after the petitioners said that their booth-level officer had asked them to submit Form 8 to update their addresses after they moved to a new home in the Santa Cruz Assembly constituency in North Goa eight years ago. However, an assistant electoral registration officer told them that their names had been deleted from the draft rolls during the special intensive revision and their Form 8 applications could, therefore, not be processed. Instead, they were reportedly asked to submit Form 6, which is used to register new voters.

Two persons were killed and at least 15 others are feared trapped after a three-storey building that was under construction collapsed in Delhi’s Chawri Bazaar area. A junior engineer and an assistant engineer with the municipal corporation have been suspended. Delhi Chief Minister Rekha Gupta said that a first information report was registered against the contractor.

The Election Commission announced a special summary revision of electoral rolls in four states and two Union Territories. The exercise will be undertaken in Arunachal Pradesh, Mizoram, Odisha, Sikkim, Chandigarh, and Dadra and Nagar Haveli and Daman and Diu, starting November. This revision will update existing electoral rolls through additions and deletions, as opposed to the special intensive revision where fresh voter lists are prepared.
