Indian Parliament Amends Law to Grant Equal Statutory Protection to ‘Vande Mataram’ as National Anthem

The Indian Parliament has passed a bill amending the Prevention of Insults to National Honour Act, 1971, aiming to provide Vande Mataram the same statutory protection as the national anthem, Jana Gana Mana.

On Wednesday, the Indian Parliament passed the Prevention of Insults to National Honour (Amendment) Bill, 2026. The legislation was moved by Minister of State for Home Nityanand Rai, aiming to grant Vande Mataram the same statutory protection as the national anthem. Offences related to disrespect towards either will now be punishable with imprisonment up to three years, a fine, or both.

During the discussion on the bill, Minister of State for Home Nityanand Rai stated that this amendment is not just a legislative change but a representation of India’s cultural heritage, national identity, and the ideals of the country’s freedom struggle. He emphasized that Vande Mataram has been a source of inspiration for freedom fighters since its inception.

He further explained that the Prevention of Insults to National Honour Act was amended in 1971 to ensure respect for the National Anthem, Jana Gana Mana. Mr Rai added that on India's first Independence Day, Sardar Vallabhbhai Patel had asked Pandit Omkarnath Thakur to render Vande Mataram on All India Radio, symbolizing its significance.

While some, like K Kanimozhi of DMK, opposed the legislation due to concerns over potential division among the populace, supporters such as Sambit Patra of BJP argued for its importance. Mr Patra highlighted that the central government has been commemorating the 150th anniversary of Vande Mataram since November last year, and through this bill, they are giving legal protection to the National Song.
