Neha Bora, president of All India Students’ Association, disputes a notice issued by a special executive magistrate requiring her to furnish a bond for maintaining peace during an inquiry, alleging violation of fundamental rights.
Student leader Neha Bora has filed a petition in the Delhi High Court against a notice issued by a special executive magistrate directing her to provide a bond to maintain peace during an inquiry. The notice was issued on Saturday following Bora's detention during a flash protest near Barakhamba Road on Friday, where she and other students were demanding the resignation of Chief Election Commissioner Gyanesh Kumar. According to reports, Bora was taken to an undisclosed location before being taken to the RK Puram Police Station, where she was held overnight. The notice invoked Sections 126, 130, and 135(3) of the Bharatiya Nagarik Suraksha Sanhita, which allow a magistrate to require a person to show cause why they should not be asked to furnish a bond to maintain public peace during an inquiry. The notice directed Bora to appear before the special executive magistrate on Monday and provide a personal bond of Rs 10,000 with a surety to 'maintain peace during the period of inquiry'.
Bora has disputed the allegations made against her, stating that the notice does not disclose any material establishing a likelihood of a breach of peace or identify a specific event or period during which such a breach is apprehended. The notice cited allegations that Bora had shouted slogans at Mandi House, repeatedly protested near Jantar Mantar despite prohibitory orders under Section 163 of the Bharatiya Nagarik Suraksha Sanhita, and instigated people to participate in a protest at Connaught Place. However, Bora has contested these allegations, stating that she had called for a peaceful gathering at Mandi House at 5 pm on Friday, from where she was detained.
Bora's lawyers have indicated that they will inform the magistrate on Monday that she would not furnish the bond and will decide their next course of action based on the official's response. The Delhi High Court is currently closed for the Dussehra vacation and is scheduled to reopen on October 26. Bora’s legal team may seek an urgent hearing during the vacation.
