Neha Bora, student leader detained for protesting against Chief Election Commissioner Gyanesh Kumar, has refused to sign a peace bond directed by a special executive magistrate. The decision comes a day after the Delhi High Court rejected her petition challenging the notice.

On Saturday, Neha Bora, president of the All India Students’ Association (AISA), announced that she will not comply with a directive to sign a peace bond by a special executive magistrate. This decision was made following the rejection of her petition by the Delhi High Court on Friday against the notice issued on October 17. The notice required Bora to furnish a personal bond of Rs 10,000 with a surety to 'maintain peace' during an inquiry period.

Bora was detained on October 16 while participating in a flash protest by AISA near Barakhamba Road demanding Kumar's resignation. She alleges that she was taken to an undisclosed location before being taken to the RK Puram Police Station, where she was held overnight and released at 6 am on the following day.

Speaking at a press conference at the Communist Party of India (Marxist–Leninist) Liberation parliamentary office in Delhi, Bora questioned whose 'peace' they were being asked to maintain. She emphasized that protests against Kumar should not be suppressed under the guise of maintaining peace, as it infringes upon the right to dissent.

The notice issued by the special executive magistrate invokes Sections 126 and 130, read with Section 135(3), of the Bharatiya Nagarik Suraksha Sanhita. These provisions allow a magistrate to require a person to show cause why they should not be asked to furnish a bond to maintain public peace and, in certain circumstances, demand one while an inquiry is pending. The notice cited allegations of Bora shouting slogans at Mandi House, repeatedly protesting near Jantar Mantar despite prohibitory orders, and instigating people to participate in a protest at Connaught Place.
