
The Hon'ble Supreme Court has nullified certain provisions of the Tribunal Reforms Act, 2021, pertaining to appointments, tenure, and service conditions of members and chairpersons of various tribunals. The judgement in Madras Bar Association vs. UOI (W.P.(C) No.1018 of 2021) is one such instance.
In a written reply to the Lok Sabha, Union Minister of Law and Justice, Shri Arjun Ram Meghwal, disclosed that the Supreme Court's judgement dated 19.11.2025 in the Madras Bar Association vs. UOI case (W.P.(C) No.1018 of 2021) has invalidated certain provisions of the Tribunal Reforms Act, 2021. The judgement pertains to the appointments, tenure, and service conditions of members and chairpersons of various tribunals. Furthermore, future statutory provisions will be formulated comprehensively, incorporating not only the aforementioned judgment but also other related Supreme Court judgements and directives on the subject, ensuring the judicial independence of the tribunals.
This information was given by the Union Minister of Law and Justice, Shri Arjun Ram Meghwal Ji, in a written reply to the Lok Sabha. The various judgments of the Supreme Court, including the one mentioned above, apply to the appointments, tenure, and service conditions of the members and chairpersons of the tribunals.
