A Delhi man has sent a legal notice to Meta, alleging covert recording using camera-equipped smart glasses. The video was posted on Instagram and viewed over 4 lakh times.
A Delhi man sent a legal notice to Meta, the technology conglomerate that manufactures Ray-Ban smart glasses, on Monday. According to the legal notice, an Instagram creator allegedly covertly recorded the man at a café in Khan Market using the smart glasses. The video was later posted as a reel on Instagram on July 26.
The man tried to report the video to Instagram but was told that it did not violate the platform's community standards. However, digital rights organisation Internet Freedom Foundation (IFF), which provided pro bono legal assistance to the man, contended that Meta is liable for the design and marketing of the device, which is ‘deliberately styled to be indistinguishable’ from regular spectacles.
In the legal notice, the man demanded that the video be taken down and that the Instagram creator publish an apology for posting it. He also demanded Rs 2.05 crore in damages, asserting that Meta ‘owed and breached a duty of care to [the man] as a victim, and is liable in negligence for its contribution to the intrusion upon his privacy’.
Meta smart glasses have a small indicator light near the right temple that turns on when a video is being recorded and flashes when a photo is being taken. However, the legal notice asserted that the ‘recording indicator on the said devices is inadequate and easily overlooked’.
